Prove the 4 essential elements of a prima facie case: duty owed, breach of duty, proximate cause, and damages.

A ‘duty owed’ is defined as a “reasonable, often legal, expectation of care or safety”.  Think of a posted speed limit being adhered to, or the proper yielding of the right of way.

When you break that expected covenant for care or safety, you’ve ‘breached’ your fiduciary responsibility to not cause damage or loss to another party… you’ve ‘breached your duty”.

Proving Proximate Cause

The heart of subrogation lies in proving proximate cause.  Properly defined, proximate cause is “the direct cause of a result”… sometimes referred to as the but/for test.  BUT FOR this action taking place, this loss or damage would not have been incurred.  It’s the actions of one, resulting in the suffering of loss by another.  The Respondent’s negligence of the duty owed, was the direct cause of the Applicant’s loss being sustained.

The fourth element of a successful prima facie case, of course, is proving that damages were both incurred and of a specific dollar value.  Verification that a negligent act resulted in a loss of value (or property), or that an injury was sustained... and the dollar amount associated with such a loss or injury.   Verification that a negligent act resulted in a loss of value or property or that an injury was sustained.
